RESOLUTION AUTHORIZING APPLICATION TO THE MINNESOTA DEPARTMENT OF TRANSPORTATION LOCAL ROAD IMPROVEMENT PROGRAM (LRIP) ROUTES OF REGIONAL SIGNIFICANCE PROGRAM FOR EAST 4TH STREET IN THE AMOUNT OF $1,500,000.

CITY PROPOSAL:
RESOLVED, that the Duluth City Council hereby finds as follows:
1. That the City of Duluth is undertaking a project to reconstruct East 4th Street from Mesaba Ave. (TH 194) to 6th Ave. East in 2028, (the “Project”).
2. Local road improvement program grants are currently available from the Minnesota Department of Transportation for construction of 2028 projects. Projects must meet the requirements of the Routes of Regional Significance Account (the “LRIP”).
3. That the Project, meets the requirements of the LRIP.
4. To receive this money, the City must submit the application to the Minnesota Department of Transportation.
RESOLVED, that the proper City officials are hereby authorized to apply to the Minnesota Department of Transportation for the LRIP for the Project.
FURTHER RESOLVED, that the City of Duluth estimates the grant amount to be $1,500,000 and will make the additional funds available primarily from Federal, Municipal State Aid (MSA) or utility funds for engineering, right of way, inspection, and other non-LRIP eligible costs for utility improvements, as well as LRIP eligible items in excess of the LRIP grant amount.
FURTHER RESOLVED, that if the City of Duluth is awarded the above grant by the Minnesota Department of Transportation, the proper City officials are hereby authorized to accept the grant award, and may enter into an agreement with the state of Minnesota for the Project. The City of Duluth will comply with all applicable laws, environmental requirements and regulations stated in the grant agreement.
FURTHER RESOLVED, that the City Council of the City of Duluth names the fiscal agent for the City of Duluth for this project as:

Statement of Purpose
STATEMENT OF PURPOSE: The Local Road Improvement Program (LRIP) was established by the Minnesota legislature in 2002. This program provides for funding of capital construction costs only, in one of four categories. The category the City is applying for is the Routes of Regional Significance Account, which assists with paying the costs to construct or reconstruct city streets with statewide or regional significance. Our application will request assistance with full reconstruction of East 4th Street from Mesaba Avenue (TH194) to 6th Ave. East. The work will consist of full reconstruction including the signal replacement at 6th Ave. East, pavement, storm sewer, watermain, sidewalk and ADA improvements. This project is already planned for construction in 2028. If we receive LRIP grant funds, we will be able to reduce our use of MSA funds in the same amount.
