RESOLUTION APPROVING LIST OF PROJECTS FOR USE OF ONE-HALF OF ONE PERCENT LOCAL SALES TAX AS REQUIRED BY LAWS OF MINNESOTA 2019, 1ST SPECIAL SESSION CHAPTER 6, ARTICLE 6, SECTION 34.

CITY PROPOSAL:
WHEREAS, the Minnesota legislature has approved Laws of Minnesota 2019, 1st Special Session Chapter 6, Article 10, Section 7 (the “special law”) authorizing the city to impose an additional one-half of one percent general sales and use tax for the purposes of paying the capital and administrative costs of street, curb, gutter, sidewalk, and bridge improvements, including related lighting and signals in the city of Duluth.
WHEREAS, the imposition of that tax is subject to the passage of a resolution by the city council outlining each of the specific capital projects that will be funded by the tax and the anticipated amount of the revenues to be raised from the tax that will be used for each project, which list will further set forth the priority of each of the projects in terms of regional significance as required by Laws of Minnesota 2019, 1st Special Session Chapter 6, Article 6, Section 34 (a).
THEREFORE, BE IT RESOLVED, that the list, attached hereto as Exhibit A, outlining each of the specific capital projects that will be funded by the tax and the anticipated amount of the revenues to be raised from the tax that will be used for each project and setting forth the priority of each of the projects in terms of regional significance is hereby approved.
FURTHER RESOLVED, that the city clerk shall promptly file with the commissioner of revenue the certification required by Laws of Minnesota 2019, 1st Special Session Chapter 6, Article 6, Section 34 (b) and is further directed to cause the same to be published as a link on the city’s homepage.
Statement of Purpose
STATEMENT OF PURPOSE: The legislation authorizing the city to impose the requested one-half of one percent sales and use tax for streets requires the city council to approve by resolution a specific list of projects that the tax proceeds can be used on, the estimated amount of tax proceeds that will be used on each project and to prioritize them by “regional significance”. That resolution must be sent to the Commissioner of Revenue before the city can begin to collect the tax.
The purpose of this resolution is to fulfill that requirement.
