RESOLUTION AUTHORIZING THE PROPER CITY OFFICIALS TO REQUEST AND ACCEPT FROM ST. LOUIS COUNTY, ON BEHALF OF THE STATE OF MINNESOTA, CERTAIN TAX FORFEITED LANDS IN THE IRVING NEIGHBORHOOD FOR $16,500, PLUS ASSOCIATED FEES.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to request and accept from St. Louis County, on behalf of the State of Minnesota, the tax forfeited lands described on Exhibit A for the following purpose: drainage or storage of storm water under a storm water management plan.

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all required documents in connection with the request and acceptance of the real property described on Exhibit A and pay $16,500 as the purchase price, together with all administrative, recording, and all other fees and costs associated with the conveyance(s); payable from Fund No. 205-130-1220-CM205-SLRNA-PHASE II (parks fund, community resources, parks capital, capital maintenance fund 205, st louis river natural area, natural resources mgmt plan/land acquisition & restoration).

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the request of and accept certain tax-forfeited lands from St. Louis County, on behalf of the State of Minnesota for the following purpose: drainage or storage of storm water under a storm water management plan.  The parcels authorized to be acquired under this resolution are listed on the attached Exhibit A (the “Parcels”).  The acquisition of the Parcels is authorized under Minn. Stat. § 282.01, Subd. 1a(h).  A map depicting the Parcels is attached as Exhibit B.

 

The City desires to acquire these parcels to use in connection with an upcoming project titled Keene Creek Green Stormwater Infrastructure Biofiltration Basin, which includes construction of a biofiltration basis near 59th Ave. W. and Main Street in an effort to provide stormwater treatment to the highly urbanized 85-acre Keene Creek watershed.  In addition, the City will vegetate the area with native plants and utilize a bio-char amended filter media to treat

diverted stormwater flows from a stormwater conveyance system before discharging into the Keene Creek Trout Stream.  The State of Minnesota Department of Natural Resources acquired a grant to fund this project.  Once constructed, the infrastructure will be owned and maintained by the Department of Public Works and Utilities.

 

The acquisition of the Parcels is being funded by a Great Lakes Restoration Initiative Grant from the United States Environmental Protection Agency (the “Grant”).  In addition to paying for the Parcels authorized by this resolution, the Grant is also funded acquisition of numerous other tax-forfeited lands that were acquired under the Strategic Lands Realignment Project, as well as development of the Natural Resources Management Plan and planting of native species on public lands along the St. Louis River.  The Grant was accepted by the City Council under Resolution No. 20-0607; the funds must be spent by December 31, 2024.
