CITY PROPOSAL:

WHEREAS, the Minnesota Department of Natural Resources (MNDNR) administers the state public water access program which provides funding to support the creation, operation and maintenance of public water access locations through a cooperative agreement with land owners; and

WHEREAS, the MNDNR has, for several decades, assisted the City of Duluth with development and maintenance of public water access sites at Park Point Recreation Area, Rice’s Point Boat Landing, Perch Lake Shore Fishing Area, Munger Landing, and Boy Scout Landing; and

WHEREAS, the previous cooperative agreements between the City and MNDNR are reaching their expiration date and both parties wish to continue in the shared operation and maintenance of these public water access sites.

FURTHER RESOLVED, that the City of Duluth has the legal authority to accept these funds and the financial, technical, and managerial capacity to ensure proper planning and maintenance of the public water access locations. There is no local matching requirement of the City of Duluth under this Cooperative Agreement.

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes acceptance of a cooperative agreement, attached as Exhibit A, between the City of Duluth and the Minnesota Department of Natural Resources to support the operation and maintenance of public water access locations along the St. Louis River, including public water access sites at Park Point Recreation Area, Rice’s Point Boat Landing, Perch Lake Shore Fishing Area, Munger Landing, and Boy Scout Landing. These sites were developed with funding from the MNDNR with operating and maintenance responsibilities set forth in Cooperative Agreements dating back to the time of original development. These public water access sites are crucial to the enjoyment of the St. Louis River Estuary by all in our community, especially following the significant restoration and remediation that has occurred as result of both parties’ participation in the St. Louis River Area of Concern, along with the Minnesota Pollution Control Agency, US Environmental Protection Agency, US Army Corps of Engineers, Wisconsin Department of Natural Resources and others.
