CITY PROPOSAL: RESOLVED, by the City of Duluth ("City") that the City act as the legal sponsor for the project contained in the Contamination Investigation and Response Action Plan (RAP) Development Grant Application in the amount of $28,834 to be submitted on May 1, 2016, and that the mayor and the city clerk are hereby authorized to apply to the Minnesota Department of Employment and Economic Development (DEED) for funding of this project on behalf of the City.

                     BE IT FURTHER RESOLVED, that the City has the legal authority to apply for financial assistance and the institutional, managerial and financial capability to ensure adequate project administration.

                     BE IT FURTHER RESOLVED, that the sources and amounts of the City match identified in the application in the amount of $9,611 are committed to the project identified, said match to be provided by Marvin Development IV, LLC.

                     BE IT FURTHER RESOLVED, that the City has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kick-back, collusion, conflict of interest or other unlawful or corrupt practice.

                     BE IT FURTHER RESOLVED, that upon approval of the City’s application by the state, the mayor and the city clerk may enter into an agreement with the State of Minnesota for the above-reference project.

                     BE IT FURTHER RESOLVED, the City certifies that it will comply with all applicable laws and regulations as stated in all contract agreements.

                     Approved by the Duluth Economic Development Authority this 25th day of April, 2016.

 

 

Statement of Purpose

STATEMENT OF PURPOSE:  Minnesota-based developer Marvin Development IV, LLC, has acquired property at 4222 Grand Avenue in Duluth at which they intend to build a Taco Bell restaurant. Due to the site’s history of hosting various automotive repair shops, as well as recently acting as a welding and machining operation, both Phase I and Phase II environmental investigations are required prior to new development.

 

The purpose of this Resolution is to authorize a state DEED Contamination Investigation and RAP Development Grant Application relating to the project site in order to secure more detailed data necessary for potential remediation and future development.  The total investigation and RAP development costs are estimated at $38,445.  DEED is allowed to award a grant for up to 75% of the estimated cost of the investigation or $50,000, whichever is less.  The City’s application will request $28,834 from DEED leaving a local match in the amount of $9,611.
