RESOLUTION AUTHORIZING A FUNDING AGREEMENT WITH THE GND DEVELOPMENT ALLIANCE FOR CONSTRUCTION OF THE SKATE PARK AT THE GARY NEW DULUTH RECREATION AREA.

CITY PROPOSAL:
WHEREAS, resolution 20-0579R authorized a five-year agreement with the GND Development Alliance (Alliance) for use, maintenance, and management of the Gary New Duluth Recreation Area; and
WHEREAS, the Alliance designed plans to construct a public skate park (Skate Park) at the Gary New Duluth Recreation Area and has completed initial phases of work on the Skate Park; and
WHEREAS, the City of Duluth and the Alliance wish to jointly fund and complete the final phase of construction of the Skate Park, where the City shall, in accordance with the City’s bidding process, award and enter into a construction contract with a contractor selected by the City, and agreed upon by the Alliance, for the construction of the Skate park; and
WHEREAS, the Alliance successfully pursued St. Louis County economic development funding in the amount of $250,000 and resolution 22-0910R authorized City officials to accept the funding for the purpose of completing the Skate Park; and
WHEREAS, resolution 23-0748R confirmed support of parks-based athletic venue capital improvement projects, including the intent to pursue City bonding of up to $300,000 for the completion of the Skate Park; and
WHEREAS, resolution 23-0691R authorized distribution of $40,000 of 2024 hotel-motel and food and beverage tourism taxes for the Alliance; and
WHEREAS, the Alliance desires to provide remaining costs associated with the Skate Park and 10% contingency to the City, in an amount not to exceed $300,000, using donations, pledges, and other grant funds awarded to the Alliance.
NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are authorized to execute a funding agreement with the Alliance, substantially in the form of the attached Exhibit A, to formalize the roles and responsibilities of the parties throughout the construction of the Skate Park, including accepting funds from the Alliance in an amount not to exceed $300,000 in association with this agreement with said funds to be deposited into fund 205-130-1220-4660-CM205-GARYND-MMPIMP (parks fund - community resources - parks capital - gifts and donations - capital maintenance fund 205 - Gary New Duluth - plan implementation).
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the proper City officials to execute a funding agreement with the GND Development Alliance (Alliance), substantially in the form of the attached Exhibit A, to formalize the roles and responsibilities of the parties throughout the construction of improvements to the Skate Park at the Gary New Duluth Recreation Area (GND Rec), including accepting up to $300,000 from the Alliance to support the Skate Park’s construction.
The City owns the property at GND Rec and the Alliance uses, maintains, and manages the facilities at the site. The City and the Alliance have worked cooperatively to support the development of the site and both parties wish to complete the Skate Park. The Alliance has successfully secured grants and donations to support construction of the Skate Park. Through previous resolutions, the City has allocated funding to support this project totaling $590,000, including $250,000 from St. Louis County economic development funding, which the Alliance successfully applied for, $40,000 of 2024 hotel-motel and food and beverage tourism taxes, and $300,000 from City bonding in association with the parks-based athletic venue capital improvement projects.
The Alliance has been and will be a collaborative partner throughout the development of the Skate Park. The City intends to put the construction of the Skate Park out for bid, award, and enter into a construction contract with the selected contractor in accordance with the terms set forth in this funding agreement with the Alliance. The Alliance will provide funds to the City for costs associated with the construction contract that are beyond the $590,000 allocated by the City, including an additional 10% contingency, with said funds to be deposited to the City prior to the start of construction. The construction of the Skate Park is expected to be substantially complete in the summer of 2024.
