RESOLUTION AUTHORIZING A FIRST AMENDMENT TO THE DEVELOPMENT AGREEMENT WITH INDEPENDENT SCHOOL DISTRICT NO. 709 REGARDING THE REDEVELOPMENT OF THE FORMER CENTRAL HIGH SCHOOL SITE.

CITY PROPOSAL:

WHEREAS, Resolution No. 22-0571 authorized the proper city officials to enter into a development agreement with Independent School District No. 709 (“ISD 709”) to set forth and formalize the terms, conditions, and goals for the redevelopment of the former Central High School site (the “Development Agreement”).

WHEREAS, the Development Agreement was registered in the Office of the St. Louis County Registrar of Titles on March 3, 2023 as Document No. 1066443 and recorded in the Office of the St. Louis County Recorder on March 3, 2023 as Document No. 1462722.

WHEREAS, the City and DEDA desire to amend the Development Agreement with a First Amendment to require ISD 709 to grant, upon 60 days notice, a permanent easement for roadway purposes to the City, in trust for the benefit of the public, over, under and across the real property legally described and depicted on Exhibit B attached to Exhibit 1.

NOW, THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to execute a first amendment to the Development Agreement, substantially the same as the agreement attached as Exhibit 1, with ISD 709 affecting the following real property in St. Louis County, Minnesota: Lot 1, Block 1, CENTRAL OVERLOOK.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes a first amendment to the development agreement (the “First Amendment”) with Independent School District No. 709 (“ISD 709”) relating to the redevelopment of the former Central High School site (the “Development Agreement”).

 

Under the Development Agreement, ISD 709 has completed or will complete the following activities: (i) demolition of former Central High School building, (ii) construction of two large structures (transportation building and district services center) and (iii) renovation of an existing structure.  Additionally, there will be a public street accessed from East Central Entrance, a public sidewalk to East Central Entrance, private storm water management facilities, public utilities, and certain other site improvements.

 

The First Amendment affects only the property still owned by ISD 709 and requires ISD 709 to grant a permanent easement for roadway purposes, at no cost to the City, upon 60 days’ notice.  In exchange, the City agrees not to assess the School District for the initial cost of construction of the road as long as the School District uses the property for its own purposes.  The location of the proposed road is legally described and depicted on Exhibit B attached to the First Amendment attached as Exhibit 1.  The proposed road will overlay an existing platted utility easement.
