RESOLUTION AUTHORIZING THE THIRD AMENDMENT TO AGREEMENT C24400 WITH THE MINNESOTA DEPARTMENT OF NATURAL RESOURCES FOR THE REPLACEMENT OF A BEACH DUNE-CROSSING BOARDWALK NEAR THE LAFAYETTE COMMUNITY CENTER.

 

Body

CITY PROPOSAL:

WHEREAS, the dune-crossing boardwalk at Lafayette Community Center was successfully replaced and the project scope came in under budget with grant funds remaining; and

 

WHEREAS, the City of Duluth and Lake Superior Coastal Program identified additional access improvements that are necessary adjacent to the new boardwalk in alignment with the purpose of the grant funding and community needs; and

 

WHEREAS, the additional scope of work to replace the deck and access steps adjacent to the Lafayette Community Center and new boardwalk has been approved by the granting agency.

 

NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are hereby authorized to execute the third amendment to the grant agreement (City contract No. C24400) with the Minnesota Department of Natural Resources, substantially in the form attached as Exhibit A.

 

FURTHER RESOLVED, the City of Duluth has the legal authority to accept these funds and the financial, technical, and managerial capacity to ensure proper planning and maintenance of the project.

 

FURTHER RESOLVED, the Duluth City Council names the fiscal agent for this project as Jen Carlson, City of Duluth Finance Director, 411 West 1st Street, Duluth, Minnesota 55802.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes the third amendment to the grant agreement (City contract No. C24400) with the Minnesota Department of Natural Resources (MNDNR) Lake Superior Coastal Program to amend the project scope and extend the term of the agreement. The original scope of work for the grant supported the replacement of the dune-crossing boardwalk near the Lafayette Community Center and that project was completed under budget with grant funds remaining. The City of Duluth and Minnesota’s Lake Superior Coastal Program identified necessary additional work adjacent to the boardwalk to utilize the remaining funds. This amendment does not change the amount of the award. This third amendment will allow for the replacement of decking and stairs that connect to the new boardwalk and extend the term of the agreement to expire on June 30, 2025.
