ORDINANCE AMENDING CHAPTER 2 OF THE DULUTH CITY CODE BY ADDING ARTICLE XXXVII ESTABLISHING THE DULUTH NONBINARY, QUEER, TRANS, TWO SPIRIT, LESBIAN, GAY, BISEXUAL, INTERSEX, AND ASEXUAL COMMISSION.

The city of Duluth does ordain:
Section 1. That Chapter 2, Article XXXVII of the Duluth City Code is hereby created as following:
Article XXXVII. Duluth Nonbinary, Queer, Trans, Two Spirit, Lesbian, Gay, Bisexual, Intersex, and Asexual Commission.
Sec. 2-192 Creation of commission. Purpose.
There is hereby established a Nonbinary, Queer, Trans, Two Spirit, Lesbian, Gay, Bisexual, Intersex, and Asexual Commission (“commission”). The purpose of this commission is to advise the mayor, city council, city departments, and community at large about issues of concern affecting nonbinary and binary queer, trans, two spirit, lesbian, gay, bisexual, intersex, and asexual (“NQT2SLGBIA”) communities. There shall be seven members on the commission. The members shall be residents of the city of Duluth or be employed in the city of Duluth. Members shall be appointed by the mayor with approval of the city council. Of the first seven appointments, three shall be for three years, two shall be for two years and two shall be for one year. Thereafter, all appointments shall be for a term of three years. In addition to being diverse in gender identity, gender expression, and sexual orientation, members of the commission shall be broadly representative of the various social, racial, religious, cultural, economic, national origin, generational, and geographic groups comprising the population of the city of Duluth and shall have a documented commitment to the NQT2SLGBIA communities.
Sec. 2-193. Officers; meetings; conduct of business.
The commission shall meet within sixty days after all of its members are appointed to elect its officers, which shall consist of a chair, a vice-chair, and a secretary. Thereafter the commission shall meet at stated intervals fixed by resolution of the commission. The commission may adopt reasonable bylaws, rules, and regulations for the conduct of its business.
Sec. 2-194. Staff support.
Staff support, including clerical services and incidental expenses, shall be provided by the city.
Sec. 2-195. Duties.
The commission shall have the following duties:
(a) To advise the mayor, city council, city departments, and the community at large about issues concerning services, policies, procedures, and facilities that are of concern to the NQT2SLGBIA communities;
(b) To serve as a forum to which individuals and groups can express concerns related but not limited to issues of homophobia and transphobia;
(c) To provide consultation to the Office of Human Rights on complaints that involve gender identity, gender expression, sexual orientation, and conversion therapy
(d) To encourage and attract NQT2SLGBIA businesses to the city of Duluth, to assist NQT2SLGBIA business located in the city, and to promote economic development, especially job creation in the city; and
(e) To provide consultation and support on improving healthcare accessibility and gender affirming care for NQT2SLGBIA community.
Section 2. That this ordinance shall take effect thirty days after its passage and publication.

STATEMENT OF PURPOSE: The purpose of this ordinance is to establish a Duluth Nonbinary, Queer, Trans, Two Spirit, Lesbian, Gay, Bisexual, Intersex, and Asexual Commission.
