CITY PROPOSAL:

Whereas, the City of Duluth is preparing plans for construction of Brighton Beach Road through Brighton Beach Park, constructing a one-way road entering from TH 61, extending 0.597 miles, and exiting at Congdon Boulevard; and

 

Whereas, State Park Road Account Design Standards require the road to follow State-Aid Rule 8820.9936 Urban New/Reconstruction Projects; and

 

Whereas, the reasons for this variance request are to minimize park impacts to include tree clearing, grubbing, grading, wetland impacts, and park restoration associated with this road construction project;

 

Now therefore be it resolved that the City of Duluth does hereby request a variance from State Park Road Account Standards to allow for reduced horizontal curves, vertical curves, and number of lanes on a one-way street as follows:

3) One-Way Street:

A minimum 20-foot unobstructed width will be provided, but the minimum standard of two through lanes on a one-way street will not be met.

 

Be it further resolved, that the City of Duluth City Council hereby indemnifies, save and hold harmless the State of Minnesota and its agents and employees of and from claims, demands, or causes of action arising out of or by reason of the construction of Brighton Beach Road in accordance with State Park Road Account Standards, and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting of this variance.

 

Statement of Purpose

STATEMENT OF PURPOSE: Brighton Beach Road will be reconstructed through Brighton Beach Park in Duluth, Minnesota, in the summer of 2024.  Work will include culvert installation, grading and roadway base, curb and gutter, bituminous pavement, and concrete walk.  The roadway will be one way with a new entrance off TH 61 approximately 475 feet northeast of the existing entrance, and the exit will be approximately 780 feet to the southwest of the existing entrance on Congdon Boulevard (MSAS 185).  The project length is 0.597 miles. The roadway is not on the state-aid system but will use State Park Road Account funding. The design has evolved to include curb and gutter on both sides of the roadway to reduce wetland, grading, and vegetation impacts from ditching, and to better accommodate the concrete walk along the lakeside. As a result, the design standard used will be State Aid Rule 8820.9936 Urban New/Reconstruction Projects as required by the State Park Road Account Design Standards.

 

A variance is being requested from these design standards for several horizontal and vertical curves, as well as allowing a one-way street through the park.  This variance request must be signed off on by the Minnesota Department of Transportation district state-aid engineer and the Minnesota Department of Natural Resources engineer. A resolution which indemnifies, saves and holds harmless the State of Minnesota is required in order for them to sign off on the variance request.
