CITY PROPOSAL:

RESOLVED, by the Duluth Economic Development Authority (“DEDA”), that DEDA act as the legal sponsor, subject to the receipt of legally required approvals, for the project contained in the Redevelopment Grant Program Application for a redevelopment project at the Armory building to be submitted on February 1, 2022, and that the President and Secretary of DEDA are hereby authorized to apply to the Department of Employment and Economic Development (DEED) for funding of this project on behalf of DEDA. 

 

BE IT FURTHER RESOLVED, that DEDA has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration.

 

BE IT FURTHER RESOLVED that the sources and amounts of the DEDA match identified in the application in the amount of not less than fifty (50) percent of the grant award are committed to the project identified, subject to the foregoing.

 

BE IT FURTHER RESOLVED that if the project identified in the application fails to substantially provide the public benefits listed in the application within five years from the date of the grant award, DEDA may be required to repay 100 percent of the awarded grant per Minn. Stat. § 116J.575 Subd. 4;

 

BE IT FURTHER RESOLVED that DEDA has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice.

 

BE IT FURTHER RESOLVED that upon approval of its application by the state,

DEDA may enter into an agreement with the State of Minnesota for the above referenced project, and that DEDA certifies that it will comply with all applicable laws and regulation as stated in all contract agreements so entered into.

 

BE IT FURTHER RESOLVED that the President and Secretary are hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant subject to the foregoing.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes DEDA to submit an application to DEED’s Redevelopment Grant Program for a grant in support of the Historic Duluth Armory, LLC project, a partnership of the Armory Arts and Music Center (AAMC) and Sherman Associates at the Duluth Armory site at 1301 London Road.

 

The purpose of the Redevelopment Grant application will be used for the abatement of hazardous materials at the Duluth Armory site. The 100,000 square foot building, constructed in 1915, contains substantial asbestos containing materials (ACM), lead, and other miscellaneous hazardous materials.  The cost of abatement is a component of an estimated $25 million redevelopment project.

 

The DEED Redevelopment Grant provides a grant award for up to 50% of the estimated total cost of the redevelopment work and requires a local match of not less than 50% of the total costs. This resolution also commits the DEDA to support the project through the provision of the local share, subject to the approvals required from the City Council, and to potentially repay the amount of the state grant in the event that the project should fail to meet its objectives.
