RESOLUTION ADOPTING A MODIFICATION TO THE DEVELOPMENT PROJECT \ MUNICIPAL DEVELOPMENT DISTRICT PROGRAM PLAN FOR DEVELOPMENT DISTRICT 17.

CITY PROPOSAL:
BE IT RESOLVED by the city council (the "council") of the city of Duluth, Minnesota (the "city"), as follows:
Section 1. Recitals
1.01 The board of commissioners of the Duluth Economic Development Authority (the "DEDA") has heretofore established Development District No.17 and adopted a Development Project/Municipal Development District Program Plan therefor. It has been proposed by the city that the city adopt a Modification to the Development Project \ Municipal Development District Program Plan for the Development District (the "Development Program Modification"), attached hereto as Exhibit A, all pursuant to and in conformity with applicable law, including Minnesota Statutes, Sections 469.124 through 469.134.
1.02 The city has performed all actions required to be performed by law prior to the Development Program Modification.
1.03 The city is expanding the boundaries of Development District No. 17 to remain consistent with and in furtherance of the development objectives of the city and is modifying the Development Program therefor.
Section 2. Findings for the Development Program Modification
2.01 The council approves the Development Program Modification and finds that: (a) the Development Program, as modified, will afford maximum opportunity, consistent with the needs of the city as a whole, and (b) the Development Program, as modified, conforms to the general plan for the development of the city as a whole.
Section 3. Approval and Adoption of Development Program Modification
3.01 The Development Program Modification, as presented to the council on this date, including without limitation the statements of objectives contained therein, is hereby adopted and shall be placed on file in the office of the DEDA Executive Director.
3.02 The staff of the city, the city’s advisors and legal counsel are authorized and directed to proceed with the implementation of the Development Program Modification.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to expand the boundaries of Development District 17 to allow the city and the Duluth Economic Development Authority (the “DEDA”) to more effectively carry out the collective economic development objectives identified in the Municipal Development District Program Plan. Most specifically, expanding our ability to facilitate tax forfeit land transactions for industrial purposes. The updated map is attached as Exhibit B.
