RESOLUTION RESCINDING RESOLUTION 25-0316R AND AUTHORIZING AN OPERATIONS AND MAINTENANCE AGREEMENT BETWEEN THE CITY OF RICE LAKE AND THE CITY OF DULUTH.

CITY PROPOSAL:

RESOLVED, that Resolution No. 25-0316R is hereby rescinded; and

FURTHER RESOLVED, that the proper city officials are hereby authorized to enter into an operations and maintenance agreement, substantially in the form attached as Document 1, between the city of Rice Lake and the city of Duluth, with regards to responsibilities and reimbursement for general roadway surface maintenance, which included, but not limited to, snowplowing, pavement maintenance, traffic sign maintenance and pavement marking maintenance for roadways under each agency’s respective jurisdictions, with said reimbursement funds deposited into City Fund 110-500-1920-4654 (General, Public Works and Utilities, Street Maintenance, Other Reimbursements).

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to rescind the city council’s April 4, 2025 approval of an operation and maintenance agreement with the City of Rice Lake. The operations and maintenance agreement authorized by Resolution No. 25-0316R was never executed and staff continued to negotiate mutually agreeable terms with Rice Lake. This resolution’s purpose is to authorize an operations and maintenance agreement between the City of Rice Lake and the City of Duluth that sets forth the responsibilities and reimbursement for general roadway surface maintenance, which include, but is not limited to snowplowing, pavement maintenance, traffic sign maintenance and pavement marking maintenance for roadways under each agency’s respective jurisdictions. The total distance of the segments covered in the agreement is less than .23 miles, and both entities have historically maintained these sections. Since the distances are nearly equal and the current maintenance practices remain unchanged, it has been agreed that neither entity will incur maintenance charges unless a project arises that falls outside the current scope of this agreement.
