RESOLUTION AUTHORIZING AGREEMENT FOR REIMBURSEMENT FROM ULLAND BROTHERS, INC. FOR COSTS RELATED TO THE BECKS ROAD LAND USE STUDY

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are authorized to enter into an agreement with Ulland Brothers, Inc., substantially in the form attached as Exhibit A for reimbursement of fifty-percent of the costs of completing a land use study for select areas adjacent to Becks Road shown on the map  attached as Exhibit B, for a total reimbursement amount not to exceed $25,000 and payable to fund 110-132-1301-4654-02.

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes an agreement with Ulland Brothers, Inc. to reimburse the City the cost of hiring a qualified contractor to prepare a land use study for select areas adjacent to Becks Road.

The City has decided a land use study of the area is needed to consider the appropriate mix of future land uses along the Beck’s Road corridor due to unique transportation, existing land use, environmental, and topographical conditions. The study area contains a mix of land annexed by the City from Midway Township and land previously within the City boundary that have not been previously considered in their current context.

The City obtained proposals from eligible firms to complete the study and MSA Professional Services, Inc., submitted the only response, which proposed to complete the study at an amount not to exceed $50,000. Both Ulland Brothers, Inc. and Iron North Productions, LLC each desire to reimburse the City for fifty percent (50%) of the total cost incurred by the City or an amount not to exceed twenty-five thousand dollars ($25,000), respectively.

Ulland is a significant property owner in the area with a special use permit to operate a quarry and is supportive of the City preparing a land use study to bring clarity to the proper mix of land uses. The land use study will inform the management of the existing special use permit and any potential future amendment requests.
