RESOLUTION AUTHORIZING APPLICATION TO AND, IF OFFERED, ACCEPTANCE OF A $150,000 MINNESOTA DEPARTMENT OF NATURAL RESOURCES OUTDOOR RECREATION GRANT TO IMPLEMENT PORTIONS OF THE WEST DULUTH SPORTS CORRIDOR MINI-MASTER PLAN PHASE I.

CITY PROPOSAL:
BE IT RESOLVED, that the city of Duluth act as legal sponsor for the project contained in the Outdoor Recreation grant application to be submitted on the 30th day of March, 2018, and that the parks and recreation manager is hereby authorized to apply to the Department of Natural Resources for funding of this project on behalf of the city of Duluth.
BE IT FURTHER RESOLVED, that the applicant has read the Conflict of Interest Policy contained in the Outdoor Recreation Grant Program Manual and certifies it will report any actual, potential, perceived or organizational conflicts of interest upon discovery to the state related to the application or a grant award.
BE IT FURTHER RESOLVED, that the city of Duluth has the legal authority to apply for financial assistance, and financial capability to meet the match requirement and ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life.
BE IT FURTHER RESOLVED, that if the city of Duluth is awarded a grant by the Minnesota Department of Natural Resources, the city of Duluth agrees to accept the award, and may enter into an agreement, substantially similar to that attached hereto as exhibit A, for the above referenced project.
BE IT FURTHER RESOLVED, that the city of Duluth has not incurred any development costs and has not entered into a written purchase agreement to acquire the property described in the cost breakdown section on this application.
BE IT FURTHER RESOLVED, that the city of Duluth has or will acquire fee title or permanent easement over the land described in the site plan included in the application.
BE IT FURTHER RESOLVED, that upon approval of its application by the state, the city of Duluth may enter into an agreement with the State of Minnesota for the above referenced project, and that the city of Duluth certifies that it will comply with all applicable laws and regulations as stated in the grant agreement including dedicating the park property for uses consistent with the funding grant program into perpetuity.
NOW, THEREFORE BE IT RESOLVED, the city council of the city of Duluth names the fiscal agent for the city of Duluth for this project as:

Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the city of Duluth to submit an application to the Minnesota Department of Natural Resources for a $150,000 Outdoor Recreation grant for improvements at Wade/Wheeler Athletic Complex, consistent with those in the council approved West Duluth Sports Corridor Mini-Master Plan. This resolution also authorizes that upon approval, the city of Duluth may enter into an agreement with the State of Minnesota, substantially the same as that attached hereto as exhibit A, for the above referenced project. The city of Duluth will provide a 1:1 match of $150,000 from fund 452-030-HANDHTAX-1505 (Tourism and Recreational Projects, Half and Half Tax Projects, Wheeler Athletic Complex). Improvements funded by this investment will include new tennis/pickle ball courts, bocce ball courts, basketball courts, upgraded little league fields, wheeler softball pin wheel, and wade right field parking lot improvements. If funded, this grant will help advance the facility as a regional tournament destination and improve the recreational experience for fans, players, and community members.
