RESOLUTION AUTHORIZING THE PROPER CITY OFFICIALS TO REQUEST AND ACCEPT FROM ST. LOUIS COUNTY, ON BEHALF OF THE STATE OF MINNESOTA, CERTAIN TAX FORFEITED LAND TO BE USED FOR ROAD PURPOSES.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to request and accept from St. Louis County, on behalf of the State of Minnesota, the following described tax-forfeited lands located in St. Louis County, Minnesota, to be used for road purposes:

 

Lots 7, 8 and 9, Block 4, BRYANT ADDITION TO DULUTH SECOND DIVISION

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all required documents in connection with the request and acceptance of the real property described above and pay all administrative fees, recording fees, and other costs associated with the conveyance; payable from Fund 535-500-1905-5535.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the request of and accept a tax-forfeited parcel (the “Parcel”) from St. Louis County, on behalf of the State of Minnesota to be used for road purposes.

 

The Parcel abuts Wellington St. in the Lincoln Park neighborhood near Lincoln Park Middle School.  The city desires to acquire the Parcel to install a water quality structure in the road and partly on the Parcel to improve drainage on Wellington St. and adjoining tracts of land.  Currently, there are drainage structures in the area where ice builds up and nearly plugs an existing pipe causing water to break out the banks during a spring thaw, which results in water spilling onto the sidewalks and grass.  These drainage structures are beyond repair and need replacement.  The new water quality structure would capture sediment and floatables from stormwater received from the street and absorb more surface water, resulting in less drainage to this Parcel and other properties along Wellington St.

 

Easements on the upper side of Wellington St. will need to be acquired in order to complete the Project.  However, it is expected that the acquisition of this Parcel will take longer, so approval is needed to acquire the Parcel prior to finalizing the easements.

 

The acquisition of the Parcels will be a free conveyance under Minn. Stat. § 282.01, Subd. 1a(e)(1).  The city will be responsible for paying the state’s administrative costs, recording fees and deed tax associated with the transaction.

 

The Parcel is depicted in red on the map attached as Exhibit A.
