CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from the United States of America, by and through the Secretary of Army, a 50-year easement for utilities for the period June 24, 2020 through June 23, 2070, over, across and in the real property legally described Exhibit A attached to Exhibit 1 and depicted on Exhibit B attached to Exhibit 1, for $2,500; payable from Fund 411, Department 035 (Capital Projects Accounts), Object 5530 (Improvements Other than Buildings) City Project No. 2095.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a 50-year easement for utilities from the United States of America, by and through the Secretary of Army (the “Army Corps”) over, across and in certain property in the Canal Park and Park Point neighborhoods, for a cost not to exceed $2,500.  The affected real property is legally described and depicted on Exhibits A and B attached to Exhibit 1.

 

The city has numerous utilities on the four quadrants of land abutting the Aerial Lift Bridge, some of which serve the bridge (e.g., electrical lines for lighting) and some of which are a part of the city’s utility systems.  Previously, the Army Corps would grant a separate easement for each utility line, all with different term and which are now expired.  When the parties were working on the new easement for the Aerial Lift Bridge, it was decided to consolidate the various utility easements into a single agreement.  The form of this easement is recordable so that it can be recorded with the St. Louis County real estate records to evidence the city’s interest in the Army Corps’ property.

 

The term of this easement is June 24, 2020, through June 23, 2070.  The commencement date starts the day after the last easement expired so that there is no gap in permission for the city’s utilities across the Army Corps’ property.

 

Although the consideration for this easement shall be the city’s construction, maintenance and operation of the Aerial Lift Bridge, the Army Corps will charge a $2,500 fee for administrative costs to review the surveys and other information, as well as administer the easement throughout its term.
