RESOLUTION OF INTENT FOR CONSTRUCTION OF RIVERWEST DRIVE (FORMERLY KNOWN AS KAYAK BAY ROAD) INCLUDING UTILITIES, UTILITY RELOCATION AND A SIGNAL SYSTEM AT GRAND AVENUE, BEGINNING AT GRAND AVENUE AND EXTENDING SOUTHERLY APPROXIMATELY 1,000’ AND TO ASSESS THE COSTS THEREOF.

CITY PROPOSAL:

RESOLVED, that pursuant to Section 61 of the City Charter, the city council hereby expresses its intent to cause the construction of Riverwest Drive (formerly known as Kayak Bay Road) including utilities, relocation of a natural gas main and a signal system at Grand Avenue, beginning at Grand Avenue (TH 23) and extending southerly approximately 1,000’ to the BNSF railroad property line, all within the easement exhibit attached as Exhibit A, and hereby requests that the mayor prepare or cause to have prepared plans, specifications and estimates of the costs therefor, and file such plans and estimates with the special assessment board, together with a recommendation as to what portion of the cost should be paid for by special assessment, the number of installments of such special assessment, and the lands which should be included in the special assessment.

 

FURTHER RESOLVED, that resolution 18-0241R is hereby rescinded.

 

Statement of Purpose

This resolution begins the formal process of making assessable the construction of Riverwest Drive including a signal system, relocation of a gas main and utilities to serve the following parcels shown and described on the recorded plat of Kayak Bay (attached as Exhibit B):

 

                     Block 1, Lot 2

                     Block 2, Lot 1

                     Block 3, Lot 1

                     Block 4, Lot 1

                     Block 4, Lot 2

 

This resolution also rescinds resolution 18-0241R which was a previous resolution of intent to construct and assess sewer and water work.  This resolution is being rescinded in order to include the gas main, road and signal improvements.

 

As provided for in Section 61 of the Charter, the process can be initiated either by petition or by action of the city council itself.  In this case the latter process is being used.  The property is owned by a single property owner, and they have entered into both the Riverwest Drive Project Agreement between the city and the property owner (city contract no. 23946) and the Riverwest Drive Gas Main Lowering Development and Assessment Agreement (city contract no. 23872) agreeing to be assessed for the cost of the assessable work covered by the two agreements.

 

As is normal, this resolution is the first step in the process.  Once approved it will trigger preparation of plans and specifications for the work and estimates of costs and assessments involved.  Notices will then be sent to the affected property owners (the agreeing owner in this case) and they will be given the opportunity to be heard before the special assessment board.  After the board makes its recommendations, the matter will return to the city council for consideration of an ordering in resolution.
