RESOLUTION AUTHORIZING CITY OFFICIALS TO EXECUTE A FUNDING AGREEMENT WITH INDEPENDENT SCHOOL DISTRICT NO. 709 TO ACCEPT FUNDING FOR THE FULL PROJECT COST TO INSTALL A PLAYGROUND ADDITION AT WASHINGTON CENTER.

CITY PROPOSAL:
WHEREAS, resolution 22-0641R authorized a three-year lease agreement with the Independent School District No. 709 (ISD 709) for use of space in the Washington Center for its Head Start and Early Childhood Family Education Programs; and
WHEREAS, ISD 709 approached the City of Duluth with a project proposal to install a playground addition designed for children ages 2-5 at Washington Center and ISD 709 has secured donations and grant funding to cover the costs of the purchase and installation of the playground addition; and
WHEREAS, ISD 709 will transfer funding in the amount of $45,743.61 to the City, so that the City can transact the purchase of the playground equipment and manage the installation of said equipment.
NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are hereby authorized to execute a funding agreement with ISD 709, substantially in the form attached hereto as Exhibit A, to accept funding for the full project cost to install a playground addition at Washington Center, with said funds to be deposited into fund 205-130-1220-4660-CM205-MISCPK-PLYGRD (Parks Fund - Community Resources - Parks Capital - Gifts and Donations - Capital Maintenance Fund - Miscellaneous Parks - Park Playgrounds).
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the execution of a funding agreement with the Independent School District No. 709 (ISD 709), substantially in the form attached hereto as Exhibit A, to accept funding for the full project cost to install a playground addition at Washington Center, located at 310 North 1st Avenue West, Duluth, MN 55806. The playground equipment and installation is currently estimated to cost $45,743.61, and ISD 709 has agreed to provide the full funding for the project. If the costs associated with the playground installation exceed $45,743.61, then the City will submit an invoice to ISD 709 for the associated costs.
ISD 709 operates at Washington Center under a lease agreement with the City of Duluth, where ISD 709 provides Head Start and Early Childhood Family Education (ECFE) Programs. In October 2022, ISD 709 submitted a Project Proposal Application to install a playground addition adjacent to the existing playground at Washington Center. The existing play equipment is designed for children over the age of five. The new playground addition is designed for children between ages 2-5, which will provide a more developmentally appropriate outdoor play area for children attending the ECFE programs and for young children living in the Hillside neighborhood area.
ISD 709 has secured the full funding for the purchase and installation of the play equipment through grants and donations. ISD 709 will transfer funding in the amount of $45,743.61 upon execution of the funding agreement to the City. The City will manage the contracts for the playground purchase and installation. If, during the process of purchase or installation, the costs associated with the playground addition exceed $45,743.61, the City will recover the costs from ISD 709. After installation, the City will own and maintain the playground addition in a manner consistent with typical playground maintenance and inspections.
