ORDINANCE AMENDING CHAPTER 21, SECTIONS 21-1, 21-35 AND 21-38 OF THE DULUTH CITY CODE TO ADOPT AND INCORPORATE THE 2015 AMENDMENTS TO THE MINNESOTA STATE FIRE CODE, WHICH IS BASED ON THE 2012 INTERNATIONAL FIRE CODE, TO AMEND THE DEFINITION OF FIRE PROTECTION SYSTEM IN ACCORDANCE WITH THE STATE AND INTERNATIONAL FIRE CODES, AND TO REQUIRE THAT LICENSED FIRE PROTECTION CONTRACTORS, BUILDING OWNERS OR THEIR AGENTS SUBMIT ANNUAL FIRE PROTECTION SYSTEM INSPECTION AND TESTING REPORTS TO THE FIRE DEPARTMENT ELECTRONICALLY VIA A METHOD APPROVED BY THE FIRE MARSHAL.

CITY PROPOSAL:

The city of Duluth does ordain:

                     Section 1.                     That Section 21-1 of the Duluth City Code is hereby amended to read as follows:

                     Sec. 21-1.                     Adoption of the Minnesota State Fire Code

                                          The city hereby adopts by reference and incorporates into this Code the Minnesota State Fire Code set forth in Minnesota Rules, Chapter 75101, which is based on the 200012 edition of the International Fire Code, and as said rules and code may be, by the state, amended from time to time, or replaced.

                     (a)                     The city adopts by reference the following appendices to said International Fire Code, their successors and amendments:

                                          (1)                     Appendix B - fire flow requirements for buildings;

                                          (2)                     Appendix C - fire hydrant location and distribu-tion;

                                          (3)                     Appendix D - fire apparatus access roads;

                                          (4)                     Appendix E - hazard categories;

                                          (5)                     Appendix H - hazardous materials management plan (HMMP) and hazardous materials inventory statement (HMIS) instructions;

                                          (6)                     Appendix I - fire protection systems - noncompliant conditions;

                                          (4)(7)                     Appendix HK - fires or barbecues on balconies or patios (as amended by Minnesota Rules, 75101.37107900, subpart 112);

                                          (8)                     Appendix L - (as amended by Minnesota Rules, 7511.7900, subpart 5).

                                          (5)                     Appendix I - special locking arrangement for group I occupancies (as amended by Minnesota Rules 7510.3710, subpart 12);

                     (b)                     Appendix B, Section 105.1, of the 200012 International Fire Code is not adopted and is not a part of the Duluth city ordinance.

 

Section 2.  That Section 21-35 of the Duluth City Code is hereby amended to read as follows:

                     Sec. 21-35.                     Definitions.

                     For the purpose of this Article, the following words and phrases shall have the meanings given them in this Section:

                     Fire marshal.  The fire marshal of the city of Duluth or other person designated by the Duluth fire chief to inspect fire protection systems and review fire protection systems plans.

                     Fire protection contractor.  A person or firm who contracts to sell, design, install, modify, alter or inspect a fire protection system or its parts or related equipment and is licensed as a fire protection contractor pursuant to Minnesota Statutes 299M.

                     Fire protection system. Approved devices, equipment and systems or combinations of systems used to detect a fire, activate an alarm, extinguish or control a fire, control or manage smoke and products of a fire or any combination thereof. A sprinkler, standpipe, hose system or other special hazard system for fire protection purposes only, that is composed of an integrated system of underground and overhead piping connected to a potable water source. Fire protection system does not include the water service piping to a city water main, or piping used for potable water purposes or piping used for heating or cooling purposes.

 

                     Section 3.  That Section 21-38 of the Duluth City Code is hereby amended to read as follows:

                     Sec. 21-38.                     Inspections; corrections.

                     (a)                     All work done in installing, extending or altering a fire protection system shall conform to all applicable codes and shall be inspected by the fire marshal;

                     (b)                     The fire marshal may order work on a fire protection system to be corrected or altered if it is found to be defective, incomplete or not in accordance with an applicable code. 

                     (c)                     Pursuant to the Minnesota State Fire Code, as adopted by reference and incorporated herein, fire protection systems shall be inspected and tested at least annually by licensed fire protection contractors in accordance with the standards and procedures listed and referenced therein, as may be amended. All inspection and testing reports completed in accordance with this Section shall be submitted electronically via a method approved by the fire marshal.

 

Section 4.                     That this ordinance shall take effect 30 days after its passage and publication.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this ordinance is to (a) adopt and incorporate by reference the 2015 Minnesota State Fire Code, which is based on the 2012 International Fire Code, along with the Fire Department’s preferred appendices attached thereto, as the fire code for the city of Duluth (“the Code”); (b) align the definition of “fire protection system” in the Code with State and International Fire Codes; and (c) direct that licensed fire protection contractors, building owners or their agents submit the annual fire protection system inspection reports required by the Code via an electronic method approved by the fire marshal.
