CITY PROPOSAL:

WHEREAS, resolution 22-0778R authorized the proper City officials to accept a $100,000 Lake Superior Coastal Program grant from the Minnesota Department of Natural Resources to replace two beach dune-crossing boardwalks on Minnesota Point, one near the Lafayette Community Center and one within the Park Point Recreation Area; and

 

WHEREAS, economic inflation and the rising cost of steel and transportation have resulted in this project being divided into two phases (Phase 1: Lafayette Community Center, Phase 2: Park Point Recreation Area); and

 

WHEREAS, resolution 23-0215R authorized the first amendment accepting additional funding for a total award not to exceed $108,182 to support an archeological survey and

Tribal monitoring by the Fond du Lac Band of Lake Superior Chippewa during the archeological survey process and during project implementation, and for which no additional match funds are required; and

 

WHEREAS, the archeological survey has been completed as required, and additional time is needed to complete the boardwalk installation.

 

NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are hereby authorized to execute the second amendment to the grant agreement (City contract No. C24400) with the Minnesota Department of Natural Resources, substantially in the form attached hereto as Exhibit A, amending the scope to include one boardwalk replacement (Lafayette Community Center) and extending the term of the contract from an original expiration date of November 30, 2023 to December 31, 2024.

 

FURTHER RESOLVED, the City of Duluth has the legal authority to accept these funds and the financial, technical, and managerial capacity to ensure proper planning and maintenance of the project.

 

FURTHER RESOLVED, the Duluth City Council names the fiscal agent for this project as Jen Carlson, City of Duluth Finance Director, 411 West 1st Street, Duluth, Minnesota 55802.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes an amendment to the grant agreement (City contract No. C24400) with the Minnesota Department of Natural Resources (MNDNR) Lake Superior Coastal Program to change the project scope and extend the term of the agreement to expire on December 31, 2024. This second amendment will reduce the project scope to include the replacement of one Park Point boardwalk (at Lafayette Community Center) rather than two and extend the term from November 30, 2023 to December 31, 2024. Splitting the project in two became necessary following pandemic-related increases in the cost of steel and other construction materials. The second Park Point boardwalk replacement project (at Park Point Recreation Area) is now expected to be paid for by a second Lake Superior Coastal Program grant.

 

The project is important because of the twin necessities to cross dunes to get to the beach and do so in a way that will not damage sensitive dune habitat. The existing beach access boardwalks are damaged and in need of replacement. The replacement dune-crossings will be constructed with pre-fabricated steel frames and topped by boards that were salvaged from the former Lakewalk. Beachgrass and other native vegetation disturbed as part of this project will also be restored. The City will meet the required 1:1 match through the use and value of the salvaged boards.
