RESOLUTION AUTHORIZING THE PURCHASE OF CERTAIN REAL PROPERTY IN THE IRVING NEIGHBORHOOD FROM MINNESOTA POWER, A DIVISION OF ALLETE, INC. FOR $100, PLUS ASSOCIATED COSTS.

CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to purchase the real property located in St. Louis County, Minnesota legally described as follows (the “Property”):

 

That part of Lot 5, Block 98, WEST DULUTH FOURTH DIVISION lying northeast of a strip of land 50 feet in width across said Lot 5, said strip of land being 7 1/2 feet wide on the SW'ly side and 42 1/2 feet wide on the NE'ly side of the centerline of the railway tracks of the Duluth Transfer Railway Company as originally constructed across said premises

 

from Minnesota Power, a division of ALLETE, Inc., a Minnesota corporation, for $100 under the terms and conditions of a purchase agreement, substantially the same as that on file with the office of the City Clerk; payable from Fund No. 535-500-1905-5535.

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all documents necessary to effectuate the acquisition of the Property and pay additional costs associated with the acquisition of the Property, including but not limited to deed tax and recordation fees.

FURTHER RESOLVED, that the City Administrator is hereby authorized to approve a modification to the legal description of the Property to more accurately describe the Property if such modification is needed.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes the acquisition of certain real property in the Irving neighborhood located adjacent to 59th Ave. W. between Main St. and Polk St. (the “Property”) from Minnesota Power, a division of ALLETE, Inc., a Minnesota corporation, for $100 under the terms and conditions of the purchase agreement attached as Exhibit 1.  The Property is vacant land that lies adjacent to other city-owned property. 

 

The City desires to acquire the Property to use in connection with an upcoming project titled Keene Creek Green Stormwater Infrastructure Biofiltration Basin, which includes construction of a biofiltration basis near 59th Ave. W. and Main Street in an effort to provide stormwater treatment to the highly urbanized 85-acre Keene Creek watershed (the “Project”).  In addition, the City will vegetate the area with native plants and utilize a bio-char amended filter media to treat diverted stormwater flows from a stormwater conveyance system before discharging into the Keene Creek Trout Stream.  The State of Minnesota Department of Natural Resources acquired a grant to fund this project.  Once constructed, the infrastructure will be owned and maintained by the Department of Public Works and Utilities.

 

The Property is depicted in blue on the map attached as Exhibit 2, with the existing city-owned property highlighted in red.  The red and blue properties will be used in connection with the Project.
