RESOLUTION AUTHORIZING A THREE-YEAR AGREEMENT WITH THE STATE OF MINNESOTA FOR AN EXCLUSIVE LICENSE TO ENTER ONTO AND OCCUPY CITY-OWNED PROPERTY IN THE FOND DU LAC NEIGHBORHOOD FOR THE PLACEMENT AND STORAGE OF A FIELD TRAILER, EQUIPMENT AND RELATED ITEMS.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute a three-year agreement with the State of Minnesota, substantially the same as the agreement attached as Exhibit 1, for an exclusive license to enter onto and occupy city-owned property in the Fond du Lac neighborhood for the placement and storage of a field trailer, equipment and related items, at no cost to the State of Minnesota.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a three-year agreement with the State of Minnesota, by and through its Commissioner of Transportation (“MnDOT”), for an exclusive license to enter onto and occupy city-owned property in the Fond du Lac neighborhood for the placement and storage of a field trailer, equipment and related items, at no cost to MnDOT. The location of the city-owned property, which is currently used as open space, is depicted in red on Exhibit 2.
MnDOT has established and designated the route of Trunk Highway No. 23 in St. Louis County Minnesota, which is near the city-owned property authorized under the license agreement. MnDOT has or will undertake an archaeological study in relation to a highway construction project for Trunk Highway No. 23 and surrounding property (the “Study”). In connection with the Study, MnDOT needs to store a field trailer, equipment and related items near Trunk Highway No. 23, but does not own property in the surrounding area suitable for this purpose. This license agreement allows MnDOT to place and store a field trailer, equipment and related items on city-owned property, as depicted in red on Exhibit 2, under the terms and conditions provided for in the license agreement.
The Fond du Lac Band of Lake Superior Chippewa reviewed MnDOT’s request to use city-owned property for this particular purpose and supports the issuance of the license agreement, which support is documented on the letter attached as Exhibit 3.
