RESOLUTION AUTHORIZING A LICENSE AGREEMENT WITH THE SOUTH ST. LOUIS SOIL AND WATER CONSERVATION DISTRICT FOR A FLOOD RECOVERY PROJECT FOR A PORTION OF SARGENT CREEK AT NO COST TO THE CITY.

CITY PROPOSAL:
WHEREAS, the South St. Louis Soil and Water Conservation District (“SWCD”) received a grant from the State of Minnesota, Department of Natural Resources for a stream restoration project for a portion of Sargent Creek (the “Project”);
WHEREAS, the Project will create a stable stream channel, establish trout habitat, repair damage that occurred as a result from the 2012 flood, improve aesthetics of the creek, and increase resilience to future flooding;
WHEREAS, the City has a 5/8ths interest in the real property where the Project will occur and desires to grant a license to SWCD to complete the Project.
NOW THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to execute a license agreement, substantially the same as the agreement attached as Exhibit 1, with SWCD, enter and occupy the property outlined in red on the attached Exhibit 2 for the purpose of completing the Project, at no cost to the city.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize a license agreement with South St. Louis Soil and Water Conservation District (“SWCD”) for a stream restoration project for a portion of Sargent Creek (the “Project”), at no cost to the city.
Under the license agreement, SWCD will perform the following tasks:
(a) Clearing of brush, vegetation, and trees from 20-foot equipment access corridors;
(b) In-stream excavation including moving and re-shaping the channel to create a stable pattern, profile, and dimension;
(c) Installation of stream grade control structures made from natural materials such as boulders or logs;
(d) Restoration of all disturbed areas with erosion control blanket and native trees and grasses.
Plans to clear and replant portions of the site will be crafted in consultation with the City Forester.
St. Louis County owns a 3/8ths interest in the property affected by the Project. SWCD has a separate, written agreement with St. Louis County to undertake the Project. SWCD is responsible to obtain all permits or other permissions to execute the Project.
