RESOLUTION REQUESTING PLANNING COMMISSION CONDUCT A PUBLIC HEARING AND PROVIDE RECOMMENDATION TO CITY COUNCIL RELATED TO VACATION DWELLING UNITS IN THE RR-1 AND RR-2 DISTRICTS

                                          WHEREAS, the city council in Resolution 23-0419R requested a city planning commission evaluation of Unified Development Code (UDC) regulations related to vacation dwelling units in the RR-1 and RR-2 districts (the “Study”)

WHEREAS, the city planning commission completed the Study with support from city planning staff, deliberated about the topic at its meetings of October 10th and November 14, 2023, and accepted public comment on the matter; and

                     WHEREAS, the city planning commission, on a vote of 6-0, recommended no immediate changes to the Unified Development Code (UDC) related to vacation dwelling units; and

                     WHEREAS, the city planning commission is the appropriate entity, under UDC Section 50-37.3, to conduct a public hearing on an ordinance change to the UDC and provide a formal recommendation regarding that change to the City Council.

                     THEREFORE, BE IT RESOLVED, that the city council requests that the city planning commission formally conduct a public hearing on an ordinance change to modify UDC Section 50-20.3.U, “Use Specific Standards-Commercial Uses-Vacation dwelling units”, and any other associated or necessary UDC sections, to provide for an exemption to the cap on vacation dwelling units for any properties in the RR-1 or RR-2 districts located within 300 feet or an MU-C zoning district, and to provide its recommendation to the city council for an ordinance amendment. 

 

Statement of Purpose

STATEMENT OF PURPOSE:  The purpose of this resolution is to request that the city planning commission hold an official public hearing consistent with UDC requirements to consider a specific update to UDC regulations for vacation dwelling units in the RR-1 or RR-2 Rural Residential zoning districts located near properties zoned MU-C, Mixed Use Commercial.

Staff and the city planning commission discussed the Study at the regular October and November meetings of the commission. The commission voted in October to return the Study to staff for further options to be considered; in November, upon further consideration, the commission voted to recommend no further actions by the city to modify the cap of the total number of vacation dwelling units outside of form districts. Exhibits to this resolution include the city council resolution requesting the study from 2023, and the previous resolution from 2021 related to VDUs (Exhibit A); the Study memo and attachments (Exhibit B); and excerpts of meeting minutes from the commission meetings (Exhibit C).

The Council recognizes the challenge of considering modifications to current VDU regulations in light of the extensive Planning Commission and Council work on this topic in 2021, but is in favor of further exploring this specific modification due to the limited number of properties city-wide that would be affected by the proposal.
