ORDINANCE AMENDING CHAPTER 2, ARTICLE XXV, OF THE DULUTH CITY CODE BY DELETING IT IN ITS ENTIRETY AND SUBSITUTING A NEW CHAPTER 2, ARTICLE XXV ESTABLISHING AN ENERGY PLAN COMMISSION.

The city of Duluth does ordain:
Section 1. That Chapter 2, Article XXV of the Duluth City Code be deleted in its entirety and replaced with the following:
Article XXV. Energy Plan Commission.
Sec. 2-131 Creation of commission. Purpose.
There is hereby established an energy plan commission. The purpose of the commission is to advise the administration and city council on ways to achieve the goal of reducing the city’s greenhouse gas emissions by 80 percent by 2050.
Sec. 2-132 Commissioners; terms; vacancies.
The commission shall consist of seven commissioners. The commissioners shall be appointed by the mayor and confirmed by the city council. Of the initial seven commissioners, two shall be appointed for four years, two shall be appointed for three years, and three shall be appointed for two years, thereafter, all appointments shall be for a term of four years. The commission members shall be residents of the city of Duluth and should broadly represent all geographic areas of the city. Collectively, commission members should have broad experience and technical expertise in areas such as renewable energy, conservation, community planning, engineering and architecture. When a vacancy occurs in the commission, by means of resignation, death, removal from the city or removal for failure or neglect to perform the duties of a commissioner, such vacancy shall be filled for the unexpired term. All terms shall expire on March 31 of the appropriate year or until commissioner’s respective successors are appointed and qualified.
Sec. 2-133 Officers; meetings; conduct of business.
The commission shall meet within 30 days after all its initial members are appointed and elect a chairperson and a vice chairperson. The commission shall adopt rules and regulations for the conduct of its business.
Sec. 2-134 Powers and duties.
(a) The commission shall have the following powers and duties:
1. Develop and recommend policies consistent with the city’s greenhouse gas reduction goals;
2. Review and evaluate city’s energy plan and assess whether benchmarks are met;
3. Promote the city’s use of clean, renewable energy resources;
4. Promote community best practices and strategies for reducing greenhouse gases; and
5. Submit a written report by January 31st of each year to the council and mayor on the city’s annual progress in reducing greenhouse gas emissions, efforts to promote the use of clean, renewable energy resources and efforts to identify community best practices and strategies for reducing greenhouse gases.
(b) The commission shall meet at least four times a year.
Section 2. That this ordinance shall take effect 30 days after its passage and publication.

STATEMENT OF PURPOSE: This ordinance establishes an energy plan commission to assist the administration and city council develop policies and programs to reduce the city’s emission of greenhouse gases by 80 percent by 2050.
