AN ORDINANCE AMENDING SECTIONS 50-20.3 u(10) and 50-20.5 m(14) to provide an exemption to the cap on vacation dwelling units and Accessory Vacation DWELLING Units IN RR-1 AND RR-2 DISTRICTS within 300 feet of a mu-c district.

BY COUNCILORS FORSMAN AND NEPHEW:

The city of Duluth does ordain:
                     Section 1.                     That Section 50-20.3.U(10) of the Duluth City Code to be amended as follows:
                     10.                      Maximum Number of Vacation Dwelling Units. No more than 60 permits may be issued for either vacation dwelling units or accessory vacation dwelling units, excepting that the maximum number of permits that may be issued shall increase by 10 percent of the net increase in housing units constructed and issued certificates of occupancy in the city in the previous year, or no more than ten (10) new vacation dwelling units per year, whichever is less, provided that the total number of vacation dwelling units authorized shall not exceed 120 units. Permits for accessory vacation dwelling units within Form Districts (F1-F9) are exempt from the maximum number of permits that may be issued. Permits for vacation dwelling units in RR-1 and RR-2 districts within 300 feet of a MU-C district are exempt from the maximum number of permits that may be issued.
                     Section 2.                     That Section 50-20.5.M(14) of the Duluth City Code to be amended as follows:
                     14.                     Maximum Number of Accessory Vacation Dwelling Units. No more than 60 permits may be issued for either vacation dwelling units or accessory vacation dwelling units, excepting that the maximum number of permits that may be issued shall increase by 10 percent of the net increase in housing units constructed and issued certificates of occupancy in the city in the previous year, or no more than ten (10) new vacation dwelling units per year, whichever is less, provided that the total number of vacation dwelling units authorized shall not exceed 120 units. Permits for accessory vacation dwelling units within Form Districts (F1-F9) are exempt from the maximum number of permits that may be issued. Permits for accessory vacation dwelling units in RR-1 and RR-2 districts within 300 feet of a MU-C district are exempt from the maximum number of permits that may be issued.
                     Section 3.                      That this ordinance shall take effect 30 days after its passage and publication.

STATEMENT OF PURPOSE:  This ordinance makes changes to Chapter 50, the Unified Development Chapter (the “UCD”).  The proposed ordinance amends the use specific standards for vacation dwelling units and accessory vacation dwelling units providing an exemption to the cap on vacation dwelling units for properties in the RR-1 and RR-2 districts that are within 300 feet of a MU-C district. See Attachment 1 for a memo explaining the proposed changes.

 

It is the role of the planning commission to review, hold a public hearing, and make recommendations to council on proposed text amendments to the UDC. At the request of city council pursuant to 23-1015R, the planning commission held a public hearing and considered the ordinance amendments at a February 13, 2024, planning commission meeting. See Attachment 2 for minutes from that meeting. Following discussion, the commission voted with 4 yeas, 3 nays, and 0 abstentions, to recommend that the city council deny the proposed text changes to the Unified Development Chapter of the City Code.
