RESOLUTION DEDICATING AND ACCEPTING A PUBLIC UTILITY EASEMENT ON CITY-OWNED PROPERTY ADJACENT TO AIRPORT ROAD.

CITY PROPOSAL:
RESOLVED, that:
(a) That the city of Duluth does hereby dedicate to the general public a public utility easement over city-owned property in St. Louis County, Minnesota, as legally described below and in the attached Exhibit.
LEGAL DESCRIPTION OF PUBLIC UTILITY EASEMENT NORTH OF AIRPORT ROAD
All that part of the 20.00 foot by 188.00 foot utility easement in Lot 3, Block 4, AIRPORT DIVISION, according to the recorded plat thereof, St. Louis County, Minnesota. Said easement was vacated per Duluth City Council Resolution 06-0569 as approved on August 22, 2005 and recorded on February 27, 2006 as Document No. 813731 on record within the Registrar of Titles of St. Louis County, Minnesota and affecting Certificate of Title No. 288785. Said easement being further described as follows:
The Northerly 188.00 feet of the Southerly 198.00 feet of the Easterly 20.00 feet of Lot 3, Block 4, AIRPORT DIVISION, according to the recorded plat thereof, St. Louis County, Minnesota.
Said parcel contains 3,760 square feet or 0.09 acres, more or less.
LEGAL DESCRIPTION OF PUBLIC UTILITY EASEMENT SOUTH OF AIRPORT ROAD AND WEST OF VANDENBERG DRIVE
An easement for utility purposes over, under, and across that part of Lots 1 and 2, Block 3, AIRPORT DIVISION, according to the recorded plat thereof, St. Louis County, Minnesota, said easement is described as follows:
Beginning at the Southeast corner of said Lot 1, thence on an assumed bearing of South 89 degrees 49 minutes 57 seconds West, along the south lines of said Lots 1 and 2 for a distance of 346.94 feet; thence North 00 degrees 10 minutes 03 seconds West 30.99 feet; thence North 89 degrees 49 minutes 57 seconds East, parallel with the south line of said Lot 2 for a distance of 20.00 feet; thence South 00 degrees 10 minutes 03 seconds East 2.26 feet; thence South 87 degrees 59 minutes 23 seconds East 320.60 feet; thence North 00 degrees 10 minutes 03 seconds West 1.50 feet; thence South 89 degrees 49 minutes 57 seconds East, parallel with the south line of said Lot 1 for a distance of 6.98 feet to the East line of said Lot 1; thence South 01 degrees 07 minutes 13 seconds West, along the east line of said Lot 1 for a distance of 18.05 feet to the Point of Beginning.
Said easement contains 7,994 square feet or 0.18 acres, more or less.
(b) That the city clerk is, pursuant to Section 100 (b)(7) of the Home Rule Charter of the city of Duluth, 1912, as amended, authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this resolution showing the easement to be dedicated.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to dedicate to the public a public utility easement. There is an existing and active 8 inch sanitary sewer pipe installed in 1956 that necessitates the need for a dedicated public utility easement in order for city staff to maintain and service underground infrastructure.
