RESOLUTION ACCEPTING PERMANENT EASEMENT FOR RECREATIONAL TRAIL AND UTILITY PURPOSES FROM INDUSTRIAL WELDERS & MACHINISTS, INC. OVER PROPERTY ADJACENT TO 40TH AVENUE WEST AND ONEOTA STREET.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for public recreational, walkway, and trail purposes and for utility purposes, substantially the same as the easement agreement attached as Exhibit 1, from Industrial Welders & Machinists, Inc. (“Industrial Welders”), at no cost to the city, over, under, and across real property legally described as:
The northwesterly 20 feet of Lots 1, 2, 3, 4, 5, 6, 7 and 8, Block 15, HARRINGTON’S ADDITION TO DULUTH; and
The northwesterly 20 feet of Lots 1, 2, 3 and 4, BOSTON PIER, ONEOTA.
The easement intended to be granted is more clearly shown on Exhibit A attached to Exhibit 1.
FURTHER RESOLVED, that, in consideration for the granting of the easement, the proper city officials are also hereby authorized to pay for improvements to Industrial Welders’ parking lot in an amount not to exceed $9,000, payable from Fund 450-030-5530 (capital improvements, finance, improvements other than buildings, cross city trail phase II), Project CP450-CCity 0595TR.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes acceptance of a permanent trail and utility easement from Industrial Welders & Machinists, Inc. (“Industrial Welders”) over property adjacent to 40th Avenue West and Oneota Street. In compensation, the resolution authorizes the City to pay up to $9000 from the half and half tourism tax fund for investment in the St. Louis River Corridor to replace portions of an Industrial Welders parking lot that will be eliminated by the trail. An aerial view of the easement area is attached as Exhibit 2. This easement will allow the City to construct a portion of the Cross City Trail (CCT) across Industrial Welders property. The attached Exhibit 3 shows all of the real estate transactions associated with construction of this segment of the CCT. The trail and parking lot improvements associated with this easement are attached as Exhibit 4.
