AN ORDINANCE GRANTING SCOTT HOLM, A CONCURRENT USE PERMIT FOR A DECK WITHIN THE PLATTED RIGHT OF WAY OF EAST 8TH STREET AT 107 EAST 9TH STREET.

CITY PROPOSAL:

The city of Duluth does ordain:
Section 1. Under the authority of Section 100 of the 1912 Home Rule Charter of the city of Duluth, as amended, and subject to the conditions, limitations and restrictions hereinafter set forth, permission is granted to Scott Holm, and its successor(s) in interests, referred to herein as the permittee, to construct and maintain a building on that property legally described in subsection below and as shown in Exhibit A:

That part of the East 9th Street right of way lying adjacent to the Southerly 62.80 feet of the Easterly 30.0 feet of Lot 19, Block 128 described as follows:

Commencing at the most Southerly corner of the easterly 30.0 feet of the Southerly 62.80 feet of said Lot 19; thence Northeasterly along the Southerly line of said Lot 19 a distance of 1.52 feet to the point of beginning of the parcel to be described; thence Southeasterly at right angles a distance of 4.0 feet; thence Northeasterly at right angles a distance of 8.33 feet; thence Northwesterly at right angles a distance of 4.0 feet to the Southeasterly line of Southerly 62.80 feet of the easterly 30.0 feet of said Lot 19; thence Southwesterly along said line to the point of beginning and there terminating.

Section 2. Before this ordinance shall be effective for any purpose whatsoever, the permittee shall file with the planning and development division (file no. PL21-151) a certification of insurance approved as to form by the city attorney evidencing that the permittee has in force a policy of insurance meeting the following requirements:
(a) Comprehensive general liability insurance in an amount not less than $1,500,000 for bodily injuries and in an amount not less than $500,000 for property damage or $1,500,000 single limit coverage; and
(b) Insurance coverage shall include all permit...
