RESOLUTION AUTHORIZING MUNICIPAL CONSENT TO ST. LOUIS COUNTY FOR THE CSAH 14 (BOUNDARY AVE) RECONSTRUCTION PROJECT - SAP 069-614-026, CP 0014-922229.

 

Body

CITY PROPOSAL:

 

WHEREAS, The Minnesota Department of Transportation is leading a resurfacing project in 2027 on US 2 beginning at the intersection with CSAH 13 (Midway Rd) and ending at the intersection with CSAH 14 (Boundary Ave), identified as SP 6908-72 and located in the cities of Hermantown, Proctor and Duluth; and

 

WHEREAS, This project will include reconstruction of CSAH 14 (Boundary Ave) beginning at Alice St and ending at a point approximately 700 ft north of US 2, installation of new roadway lighting along CSAH 14 (Boundary Ave) and replacement of the traffic signal system at the intersection of US 2 and CSAH 14 (Boundary Ave) which the improvements on CSAH 14 (Boundary Ave) are identified as SAP 069-614-026 and CP 0014-922229, city project no. 2290; and

 

WHEREAS, The improvements on CSAH 14 (Boundary Ave) includes construction of new sidewalk and shared-use paths and improved access management; and

 

WHEREAS, The City of Duluth does not have any cost participation in the improvements on CSAH 14 (Boundary Ave) or the replacement of the traffic signal system at the intersection of US 2 and CSAH 14 (Boundary Ave); and

 

WHEREAS, St. Louis County will be responsible to own and maintain the new lighting system on CSAH 14 (Boundary Ave) and share maintenance responsibilities for the new traffic signal system with the Minnesota Department of Transportation; and

 

WHEREAS, Minnesota Statutes §162.02, Subd. 8 states no portion of the county state aid highway system lying within the corporate limits of any city shall be constructed, reconstructed, or improved nor the grade thereof changed without the prior approval of the plans by the governing body of such city and the approval shall be in the manner and from required by the commissioner; and

 

WHEREAS, the construction plan has been presented to the City Engineer, copies of which are on file at the office of the City Engineer.

 

THEREFORE, BE IT RESOLVED, that the City Council of Duluth, Minnesota hereby approves the construction plan for the CSAH 14 (Boundary Ave) Reconstruction Project and that this approval will serve as municipal consent to satisfy the requirements of Minnesota Statutes §162.02 Subd. 8.

 

Statement of Purpose

STATEMENT OF PURPOSE: St. Louis County is partnering with MnDOT on this 2027 construction project. Because a portion of this work is within city limits, the project requires municipal consent from Duluth.
