CITY PROPOSAL:
WHEREAS, the Minnesota Department of Natural Resources (MNDNR) administers the state public water access program which provides funding to support the creation, operation and maintenance of public water access locations through a cooperative agreement with land owners; and

WHEREAS, the MNDNR has, for several decades, assisted the City of Duluth with development and maintenance of public water access sites at Park Point Recreation Area, Rice's Point Boat Landing, Perch Lake Shore Fishing Area, Munger Landing, and Boy Scout Landing; and

WHEREAS, the previous cooperative agreements between the City and MNDNR are reaching their expiration date and both parties wish to continue in the shared operation and maintenance of these public water access sites.

NOW, THEREFORE, BE IT RESOLVED, that the proper City officials are authorized to accept and execute the cooperative agreement, substantially in the form of the attached Exhibit A, including accepting funds in an amount not to exceed $7,500 with said funds to be deposited into fund 205-130-1220-4220-02-CM205-PKMTCE (parks fund, community resources, park maintenance, State of Minnesota operating, capital maintenance fund 205, park maintenance), for operation and maintenance of public water access locations along the St. Louis River.

FURTHER RESOLVED, that the City of Duluth has the legal authority to accept these funds and the financial, technical, and managerial capacity to ensure proper planning and maintenance of the public water access locations. There is no local matching requirement of the City of Duluth under this Cooperative Agreement.
