RESOLUTION AUTHORIZING A CHALLENGE PARTNERSHIP AGREEMENT WITH THE DEPARTMENT OF THE ARMY, U.S. ARMY CORPS OF ENGINEERS TO DONATE A PORTION OF A PEDESTRIAN WALKWAY THAT WAS INADVERTENTLY CONSTRUCTED ON PROPERTY OWNED BY THE UNITED STATES OF AMERICA.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a challenge partnership agreement, substantially in the form attached as Exhibit 1, with the Department of the Army, U.S. Army Corps of Engineers to donate a portion of a pedestrian walkway that was inadvertently constructed on property owned by the United States of America; the value of the walkway to be donated is $4,770.00.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a challenge partnership agreement, substantially in the form attached as Exhibit 1, with the Department of the Army, U.S. Army Corps of Engineers ("USACE") to donate a portion of a pedestrian walkway that was inadvertently constructed on property owned by the United States of America ("USA").
After the Lakewalk incurred repeated from storm events, the City reconstructed the Lakewalk to be more resilient to future storms. The Lakewalk reconstruction project included construction of a plaza and pedestrian walkway adjacent to a city-owned parking lot more commonly known as the "Lighthouse Lot."
USACE is in the midst of reconstructing shoreline on property owned by the USA that lies adjacent to the Lighthouse Lot. While performing survey work for its project, USACE determined that approximately three feet of the pedestrian walkway constructed in connection with the City's Lakewalk reconstruction project was constructed on USA property. The simplest way to address this is donate the encroachment to USACE. The value of the pedestrian walkway to be donated is $4,770.00.
