RESOLUTION AUTHORIZING LICENSE AGREEMENT WITH MOUNT ROYAL PINES LIMITED PARTNERSHIP FOR THE TEMPORARY USE OF PROPERTY ABUTTING ST. MARIE ST. IN THE CHESTER PARK-UMD NEIGHBORHOOD, AT NO COST TO THE CITY.

CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to execute a license agreement, substantially the same as the agreement attached as Exhibit 1, with Mount Royal Pines Limited Partnership a Minnesota limited partnership for the temporary use of certain real property abutting St. Marie St. in connection with the upcoming reconstruction of St. Marie St., at no cost to the city.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes a license agreement, substantially the same as the agreement attached as Exhibit 1, with Mount Royal Pines Limited Partnership for the temporary use of certain real property abutting St. Marie St. in the Chester Park-UMD neighborhood to make improvements related to the reconstruction of St. Marie St., at no cost to the city.  Improvements to be constructed under the license agreement are one or more of the following items (collectively, the “Ancillary Work”): (i) tie-in of the property to St. Marie St.; (ii) slope grading; (iii) asphalt replacement; and/or (iv) restoration of vegetation disturbed during construction through re-seeding. 

 

The City will be completing a reconstruction of St. Marie St. between Woodland Avenue and Vermilion Road, which includes replacement of the existing watermain and driveway aprons, upgrades to the stormwater system, and construction of a shared use trail (the “Project”).  Mount Royal Pines Limited Partnership is granting the license agreement so that Ancillary Work can be performed as part of the Project.  If the Ancillary Work is not performed, there will be differences in the grade of the right-of-way and the adjoining property.

 

The property subject to the license agreement is depicted on Exhibit B attached to Exhibit 1.
