CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a three-year non-exclusive use agreement, substantially in the form attached as Exhibit 1, with the Duluth Softball Players Association for use of Tony Emanuel Field at Woodland Community Center for its adult softball league.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a three-year agreement with the Duluth Softball Players Association (“DSPA”) for use of Tony Emanuel Field (“Field”) at Woodland Community Center for its adult softball league. DSPA may use the Field between May 1 and August 31 during each year of this agreement. In this period, DSPA will have exclusive use on Tuesdays from 8:45 to 10:45 pm and on Wednesdays from 6:30 to 10:30 pm. All other use shall be non-exclusive. There is no usage fee associated with this agreement. DSPA is responsible to prepare the Field for its practices and games, which duties include infield dragging, chalking, and ag-lime application. In addition, DSPA is responsible to maintain the Field in a clean and orderly condition and shall pick up all paper, garbage, and other debris generated from its use.
