RESOLUTION DESIGNATING DOCK SITES ALONG THE MARTEN TRAIL.

CITY PROPOSAL:

WHEREAS, the city council is considering Ordinance 26-017-O, which establishes regulations governing the location and permitting of dock sites along the Marten Trail corridor and this resolution is conditioned upon the effectiveness of said ordinance; and

 

WHEREAS, implementation of Ordinance 26-017-O contemplates the adoption of an official map designating permitted dock locations used in connection with permitted egress trail for purpose of placing a dock in the Saint Louis River estuary.

 

NOW, THEREFORE, BE IT RESOLVED, that pursuant to Section 35-37 of the Duluth City Code, 1959, as amended, those certain areas along the Marten Trail abutting the Saint Louis River estuary as described in Exhibit A attached hereto and made a part hereof are hereby designated as dock sites.

 

Statement of Purpose

STATEMENT OF PURPOSE:  The purpose of this resolution is to formally adopt the official map of designated permitted dock sites referenced in Ordinance 26-017-O, which adopts Article V of Chapter 35 of the Duluth City Code relating to private access across publicly owned property. The locations on this map are the only allowed locations for egress across public property and the only locations where a dock is allowed to go. Adoption of this map provides a clear visual depiction of the areas subject to regulation, ensuring transparency for property owners, staff, and the public. Establishing the map by resolution allows for consistent administration of Ordinance 26-017-O and supports the City’s implementation of trail and dock-site management policies.
