Title

RESOLUTION AUTHORIZING THE PROPER CITY OFFICIALS TO REQUEST AND ACCEPT FROM ST. LOUIS COUNTY, ON BEHALF OF THE STATE OF MINNESOTA, CERTAIN TAX FORFEITED LAND TO BE USED FOR ROAD PURPOSES.

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to request and accept from St. Louis County, on behalf of the State of Minnesota, the following described tax-forfeited lands located in St. Louis County, Minnesota, to be used for road purposes:

Lots One and Two, Block 17, RIVER SIDE PARK 2ND ADDITION TO DULUTH

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all required documents in connection with the request and acceptance of the real property described above and pay all administrative fees, recording fees, and other costs associated with the conveyance; payable from Fund 110-500-1930-2300-5303.

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the request of and accept certain tax-forfeited parcels (the “Parcels”) from St. Louis County, on behalf of the State of Minnesota to be used for road purposes.

The Parcels are two lots abutting Lanigan Blvd. in the Smithville neighborhood.  The city doesn’t have a legal way for plow and emergency vehicles to turnaround on Lanigan Blvd.—if the Parcels are acquired, the city can construct and maintain a turnaround for such vehicles.

The acquisition of the Parcels will be a free conveyance under Minn. Stat. § 282.01, Subd. 1a(e)(1).  The city will be responsible for paying the state’s administrative costs, recording fees and deed tax associated with the transaction.

The Parcels are depicted in red on the map attached as Exhibit A.
