RESOLUTION ACCEPTING A PERMANENT EASEMENT FOR PEDESTRIAN PURPOSES FROM MORGAN PARK ESTATES LAND DEVELOPMENT, LLC OVER, UNDER, AND ACROSS PROPERTY LOCATED IN THE MORGAN PARK NEIGHBORHOOD, AT NO COST TO THE CITY.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from Morgan Park Estates Land Development, LLC, a perpetual easement for pedestrian purposes over, under, and across the lands legally described on Exhibit A attached to Exhibit 1 and depicted on Exhibit B attached to Exhibit 1, at no cost to the City.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a perpetual easement for pedestrian purposes from Morgan Park Estates Land Development, LLC (“Developer”) over, under, and across property lying between 90th Ave. W. and 88th Ave. W. and between Falcon Street and Hilton Street, at no cost to the City.
The City has been working with the Developer to redevelop property previous known as the site of the former Morgan Park School. The Developer has been working to construct quality, market rate, multi-family housing consisting of eight 12-plex apartment buildings (the “Development”). As a condition of the Development Agreement between the City and Developer, among other things, the Developer has to design and construct a paved trail with the Development and dedicate an easement for the public to use said trail. The acceptance of this easement satisfies this condition of the Development Agreement.
Under the terms of the easement agreement, the Developer (or subsequent owners of the property) shall be responsible to maintain the easement area in a clean and neat condition and shall take such measures as are necessary to control grass, weeds, blowing dust, dirt, litter, snow, ice and debris.
