RESOLUTION AUTHORIZING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF DULUTH AND HNH, LLC, FOR THE DEVELOPMENT OF THE PLAT “REARRANGEMENT OF PART OF WESTERN WOODS DIVISION” LOCATED SOUTHEAST OF ANDERSON ROAD AND DECKER ROAD.

CITY PROPOSAL:

 

                     RESOLVED, that the city council does hereby approve a development agreement with HNH, LLC (“Developer”), and Michael E. Wilson and Kathleen M. Wilson (“Additional Owner”) substantially in the form of that attached hereto as Exhibit A, for the re-platting of 11.3 acres southeast of Anderson Road and Decker Road into the REARRANGEMENT OF PART OF WESTERN WOODS DIVISION to facilitate residential development of the property.

 

Statement of Purpose

STATEMENT OF PURPOSE:  The purpose of this resolution is to obtain the city council’s approval of the development agreement between the City of Duluth and HNH, LLC, for the re-platting and development of the REARRANGEMENT OF PART OF WESTERN WOODS DIVISION. (See staff report in Exhibit B.)

 

The “Additional Owner” is included in the agreement because they are the owner of one lot in the existing plat to be replatted, but are not a party to the development of the lots beyond giving HNH, LLC permission to install a public street across their property according to the plat.

 

The Developer’s proposal is to replat 17 lots and 3 acres of unplatted land into 15 lots for an 11.3 acre residential development consistent with the R-1 Residential-Traditional zoning of the property.  The development agreement addresses conditions including land platting, infrastructure installation, tree and wetland preservation. The Developer has not requested public assistance or any form of business subsidy.

 

The REARRANGEMET OF PART OF WESTERN WOODS DIVISION final plat was approved by the planning commission May 9, 2023 by a vote of 5 yeas, 0 nays, and 0 abstentions.
