RESOLUTION ACCEPTING A PERMANENT EASEMENT FOR STREET AND UTILITY PURPOSES FROM NANCY J. KALINA, LAURIE M. K. CHRISTIAN, F/K/A LAURIE M. KALINA AND BENJAMIN C. CHRISTIAN OVER, UNDER, AND ACROSS CERTAIN REAL PROPERTY IN THE DULUTH HEIGHTS NEIGHBORHOOD, AT NO COST TO THE CITY.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from Nancy J. Kalina, Laurie M. K. Christian, f/k/a Lauria M. Kaline and Benjamin C. Christian, a perpetual easement for street and utility purposes over, under, and across the real property legally described and depicted on Exhibit A attached to Exhibit 1, at no cost to the City.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a permanent easement for street and utility purposes from Nancy J. Kalina, Laurie M. K. Christian, f/k/a Laurie M. Kalina and Benjamin C. Christian over, under, and across certain property in the Duluth Heights neighborhood, at no cost to the City.
Later this year, the City will be reconstructing Eklund Ave. from Maple Grove Road to Swan Lake Road (the “Project”). The reconstructed street will be a bituminous road with curb and gutter. ADA compliant sidewalks will be also added to the corridor. Additionally, all watermains and storm sewer will be replaced as part of the Project. The majority of the Project will be completed within existing right-of-way, but there are a few areas where the City needs to expand the existing right-of-way. The acceptance of this easement allows: (i) the City to complete the Project and (ii) for public use of the soon-to-be expanded Eklund Ave.
