AN ORDINANCE AMENDING UDC SECTION 50-41.16; PRINCIPAL USE DEFINITION.

CITY PROPOSAL:

Section 1: That the new definition of Principal Use be added to Section 50-41.16 of the Duluth City Code, 1959 as follows:

50-41.16 Definitions: P

Principal Use. A use that is the primary use of the zoning lot upon which it is situated and that is specifically listed in the Table 50-19.8 as a permitted or special use in the zoning district in question; for unlisted uses follow the process in Sec 50-19.7.

Section 2: That the definition for Principal use or structure be amended as follows in Section 50-41.16 of Article 6 of the Duluth City Code, 1959:

50-41.16 Definitions: P

Principal use or structure.  All uses or structures that are not accessory uses or structures. The main building or other structure on a lot that is utilized for the property’s principal use.

 

Statement of Purpose

STATEMENT OF PURPOSE: This ordinance amends the principal use definition and adds a principal structure definition.

 

The planning commission held a public hearing for PLUTA-2412-0003 and considered the ordinance amendments at a Tuesday, February 11, 2025, planning commission meeting. Following discussion, the commission voted with 5 yeas, 0 nays, and 0 abstentions, to recommend that the city council approve the proposed text changes to the Unified Development Chapter of the City Code.
