RESOLUTION AUTHORIZING A TEMPORARY CONSTRUCTION EASEMENT AGREEMENT WITH U.S. BANK NATIONAL ASSOCIATION RELATED TO A FOUNDATION DRAIN.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into an agreement substantially in the form of that attached hereto as Attachment 1 with U.S. Bank National Association, a national banking association under the laws of the United States of America, pursuant to which said bank will grant the city a temporary easement at no cost to the city to allow the city to design and construct a replacement for a previously-existing foundation drain for the bank building as part of the Kenwood/Arrowhead project.

Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the city to enter into an agreement with U.S. Bank to accept a temporary easement so the city can design and have constructed a foundation drain to replace one destroyed as a result of work that was part of the Kenwood/Arrowhead project.

As part of that project the banks agreed to give up their access driveways which provided direct access to Arrowhead Road because they were too close to the intersection with Kenwood Avenue/Howard Gnesen Road. In exchange the city constructed access from Warren Avenue and reconfigured the driveway access of both U.S. Bank and Wells Fargo.

Unfortunately, the existence of a foundation drain at the southeast corner the U.S. Bank building and its outlet were missed in the design, resulting in that drain being blocked and rendered ineffective. This likely would have been problematic in the long run, perhaps causing flooding in the building, damage to the foundation, or both.

This situation needs to be corrected expeditiously. Not only would the onset of winter impede the construction itself, but the impending closing of the area blacktop plants means that the design and construction of the correction must be undertaken and completed as soon as possible.
