CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from the United States of America, by and through the Secretary of Army, a perpetual easement for road or street and associated utility infrastructure over, across and in the real property legally described Exhibit A attached to Exhibit 1 and depicted on Exhibit B attached to Exhibit 1, at no cost to the city.

Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the acceptance of a permanent easement for road or street and associated utility infrastructure from the United States of America, by and through the Secretary of Army (the "Army Corps") over, across and in certain property connecting Canal Park to the Park Point neighborhood, at no cost to the city. The affected real property is legally described and depicted on Exhibits A and B attached to Exhibit 1.

This easement is for the Aerial Lift Bridge (road/street) and the utilities physically attached to the Aerial Lift Bridge. The city has received other easements from the United States of America for the Aerial Lift Bridge over the years, but none of them were in a form that allowed them to be recorded with the St. Louis County real estate records. The parties have been working together to create a recordable interest for the city and consolidate appurtenant agreements.
