CITY PROPOSAL:

Resolved, that the city council does hereby approve the Development Agreement (the "Agreement") between the City of Duluth ("City") and Ben Grams and Adeline Grams (formerly Adeline nee Green), individuals married to each other (together "Developer"), substantially in the form of that attached as Exhibit A, related to the 2309 West 8th Street residential demolition and development located in Duluth, Minnesota.

Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to obtain the city council's approval of a development agreement amending and restating in whole a development agreement previously signed on June 22nd, 2021, between the City of Duluth and Ben Grams & Adeline Grams (formerly Adeline nee Green) for the demolition and development of the 2309 West 8th Street Project located at 2309 West 8th Street in Duluth, Minnesota. The project will be located on property that was previously occupied by a blighted building that had been condemned for human habitation due to a fire.

The original Development Agreement was signed by all parties electronically on June 22nd, 2021 due to the COVID-19 Pandemic. Because the original document was signed electronically, it is not in recordable form. The original document is terminated through the action of amending and restating. This updated document will allow for the wet signatures required for the Agreement to be recorded against the property.

The amended and restated development agreement also extends the construction timeline of the project to facilitate the construction of not less than one (1) primary housing unit with a minimum of two (2) bedrooms of affordable housing constructed by the end of 2024.
