CITY PROPOSAL:

RESOLVED, that the city council approves settlement in the amount of $10,373.96 of all claims or causes of action asserted by The Standard Fire Insurance Company on behalf of its insured Brett Bursch, pursuant to a settlement agreement, attached here to as Exhibit A, and further authorizes the proper city officials to take all actions necessary to conclude this matter on a full, final and complete basis; payment to be made from Fund No. 610-036-1651-5841 (Self Insurance Liabilities, Insurance Accounts, Insurance General City, Liability Claims Expense).

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes settlement with The Standard Fire Insurance Company of a claim against the City arising out of an incident that took place on or about December 19, 2022, at or near 120 E. Niagara Street, Duluth, Minnesota, wherein The Standard Fire Insurance Company alleges that its insured suffered property damages. The city has fully investigated the negligence and damages claims and defenses asserted in this case. The administration and city attorney recommend approval of this settlement agreement.
