RESOLUTION AUTHORIZING AN AGREEMENT WITH VEIT AND COMPANY, INC. FOR CLEAN FILL MATERIAL IN PORTIONS OF THE FORMER DWP PROPERTY.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute an agreement, substantially the same as the agreement attached as Exhibit 1, with Veit and Company, Inc. for approximately 15,000 cubic yards of clean fill material to cap surface soil contamination at the former DWP Property to MPCA standards that will allow use by the City for recreational and other uses. Funds expended for permit costs in connection with this agreement shall be paid from Fund 255-020-5441 (economic development, planning, other services & charges).
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes an agreement with Veit and Company, Inc. ("Veit") for approximately 15,000 cubic yards of clean fill material to cap surface soil contamination at the former DWP Property to MPCA standards that will allow use by the City for recreational and other uses. Veit's ordinary business operations result in excess clean fill material of limited commercial value, but said material is useful and appropriate to serve as fill on the former DWP property. Said DWP property is legally described on Exhibit A and depicted in Exhibit C to the attached agreement.
Under the terms of the agreement, Veit will haul, place, and grade clean fill material in designated portions of the former DWP property, which is now city-owned property. Veit will transport said fill material on a route designated by City from the source site to the former DWP property. Veit is required to implement and follow best management practices when transporting the clean fill material, including load protection, prevention of load loss, street sweeping, and cleaning along the designated transportation route.
