CITY PROPOSAL:
RESOLVED, that the city council approves settlement of the matter of Jared Fyle v Tyler Leibfried and the City of Duluth, venued in the United States district court, district of Minnesota, file no. 23-CV-03466 (KMM/LIB), pursuant to the terms and conditions of a settlement agreement substantially in the form of that attached hereto as Exhibit 1.
FURTHER RESOLVED, that the proper city officials are authorized to take all actions necessary to conclude this matter on a full, final, and complete basis; payment of $600,000.00 to be made from fund no. 610-036-1651-5841 (Liability Claims Expense) by check payable to Robins Kaplan LLP IOLTA; said funds represent the total settlement amount to be paid to Jared Fyle.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes city officials to enter into and implement the Settlement Agreement in Jared Fyle v Tyler Leibfried and the City of Duluth. City administration and the city attorney recommend approval of this settlement agreement.
