AN ORDINANCE AMENDING SECTION 50-39, ENFORCEMENT AND PENALTIES.

CITY PROPOSAL:

The city of Duluth does ordain:

                     Section 1. That Section 50-39, Enforcement and Penalties, of the Duluth City Code, 1959, as amended, be amended as follows, as shown in Attachment 1.

 

Section 2. That this ordinance shall take effect 30 days after its passage and publication.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This ordinance implements a text amendment related to enforcement tools regulated by chapter 50 of the City Code, known as the Unified Development Chapter (UDC).

This proposed text change creates new language for section 50-39.3 related to enforcement, providing for revocation of permits after other enforcement tools have failed to result in compliance. The proposed amended language provides an additional enforcement tool for the Land Use Supervisor and planning staff to more easily, speedily, and efficiently enforce the zoning code and ensure that conditions attached to planning commission approval for Special Use Permits and Interim Use Permits have been implemented.

 

The planning commission held a public hearing and considered the changes at a special August 24, 2021, planning commission meeting.  Following discussion and one recommended change to the proposed text related to variances, the commission voted with 7 yeas, 0 nays, and 0 abstentions, to recommend that the city council approve the text change to the Unified Development Chapter of the City Code.
