RESOLUTION ACCEPTING PERMANENT EASEMENT FOR UTILITY PURPOSES FROM THE REGENTS OF THE UNIVERSITY OF MINNESOTA OVER, UNDER, AND ACROSS CERTAIN REAL PROPERTY IN THE CHESTER PARK-UMD NEIGHBORHOOD, AT NO COST TO THE CITY.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from the Regents of the University of Minnesota, a Minnesota constitutional corporation, a perpetual utility easement for (i) gas purposes over, under, and across the real property legally described on Exhibit A attached to Exhibit 1 and depicted as “Parcel B” on Exhibit C attached to Exhibit 1 and (ii) stormwater and drainage purposes over, under, and across the real property legally described on Exhibit A attached to Exhibit 1 and depicted as “Parcel C” and “Parcel D” on Exhibit C attached to Exhibit 1, at no cost to the City.

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes the acceptance of permanent utility easements from the Regents of the University of Minnesota (the “University”) over, under, and across certain property in the Chester Park-UMD neighborhood, at no cost to the City.  The easement areas accepted under this resolution are depicted as “Parcel B, “Parcel C” and “Parcel D” on Exhibit C attached to Exhibit 1.  Parcel B is for gas purposes, while Parcels C and D are for stormwater and drainage purposes.

 

Later this year, the City will be reconstructing College Street between Junction Avenue and Woodland Avenue (the “Project”). The Project includes utility work, a new shared-use path, and sidewalk and stormwater improvements. 

 

The City’s real estate records were reviewed during the design phase of the Project, and it was discovered that there was an area within the University’s property that contained part of a public gas main that the City did not have an easement for.  There will be new culverts installed along College St. as part of the Project, with the intent of being added to the City’s storm sewer system.  The University is willing to grant easements for the current and future utility infrastructure through the easement agreement attached as Exhibit 1.

 

The acceptance of this easement creates public rights in the easement areas so the City can operate, maintain and repair the utility infrastructure.
