CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute a twenty-five year license agreement with BNSF Railway Company, a Delaware corporation (“BNSF”), substantially in the form as the agreement attached as Exhibit 1, for the operation and maintenance of a bicycle and pedestrian walkway to be used in connection with the Cross City Trail for $4,253, payable from Fund 450-030-5530, CP 450-CCity-1510.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a twenty-five license agreement with BNSF Railway Company, a Delaware corporation (“BNSF”), for the operation and maintenance of a bicycle and pedestrian walkway to be used in connection with the Cross City Trail (CCT) for $4,253. The areas subject to the license agreement are depicted on Exhibit A attached to Exhibit 1. Under the terms of the license, the City is responsible for maintenance and use of the trails.
